These Terms & Conditions explain who you are dealing with when you request a quote or place an order through this website, how our supply chain works, and your rights as an Australian consumer.
1. Who You're Contracting With
BlueTech Windows Australia is the trading name of Hazel Grouse Pty Ltd (ABN 32 646 283 552). Hazel Grouse Pty Ltd is the Australian importer and is the seller of record for all orders placed by Australian customers — it is the entity you are contracting with, invoiced by, and who is responsible for your order in Australia. Registered address: NSW 2223, Australia
2. Supply & Export Partner
The PVC windows we supply are manufactured by third-party manufacturers in Poland and sourced, supplied and exported to Australia by BlueTech Windows Miłosz Zawadowski (NIP PL7312036589, registered address Wileńska 65/1, 95-200 Pabianice, Poland). Hazel Grouse Pty Ltd imports these products and on-sells them to customers in Australia. BlueTech Windows Miłosz Zawadowski is not the seller of record for Australian orders and does not contract directly with Australian customers.
3. Quotes & Orders
Quotes provided through this website or by our sales team are estimates based on the information you provide and are not binding offers. A binding contract is formed only when Hazel Grouse Pty Ltd issues a formal order confirmation or invoice and you accept it. Lead times, pricing and product availability are subject to change until an order is confirmed.
4. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. As the Australian importer and supplier, Hazel Grouse Pty Ltd is responsible for honouring these statutory consumer guarantees, with supply-chain and warranty support from BlueTech Windows Miłosz Zawadowski as our export partner. Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law.
5. Warranty & Claims
If you believe your order has a fault or does not meet the consumer guarantees described above, contact us at support@bluetechwindows.com.au with your order details and a description of the issue. We will acknowledge your claim within 2 business days and advise next steps, which may include repair, replacement or refund in line with the Australian Consumer Law.
6. Delivery, Pricing & GST
Delivery timeframes quoted are estimates only and may vary due to manufacturing, customs or freight conditions. Prices quoted are in Australian dollars (AUD) and, unless stated otherwise, are inclusive of GST. Risk in the goods passes to you on delivery.
7. Limitation of Liability
To the extent permitted by law, our liability for any loss or damage arising from your order is limited to the remedies available under the Australian Consumer Law. We are not liable for indirect or consequential loss. Nothing in these Terms limits any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
8. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
